Why are workers’ compensation claims commonly denied?

On Behalf of | Oct 4, 2019 | Workers Compensation

Workers’ compensation is theoretically available to the vast majority of workers in the United States when they become injured at work. However, due to errors in the application process or complex situations, many workers’ compensation claims are denied.

If you have been injured at work and you are considering filing for workers’ compensation, you should make sure that you are aware of some of the most common reasons for an application denial. This will help you to avoid potential mistakes in your own application process.

Pre-existing conditions can complicate a case

If you were injured at work, the experience may have meant that an existing condition that you had, such as chronic back pain, worsened. Your medical provider will likely mention the existence of a pre-existing medical condition in their paperwork. The insurance company may try to argue that you were already injured before the accident and that you are therefore not eligible for compensation.

You were intoxicated or using drugs

Any form of drug, whether legal or illegal, could affect your ability to perform safely at work. If you were found to be using prescription drugs that cause drowsiness, for example, the insurer may try to argue that you are not eligible to claim workers’ compensation.

You did not report in time

You should report the accident to your employer as soon as you can after the event. They will have the responsibility to provide you with the initial paperwork, and you should file your claim within 30 days.

If you are concerned about being able to successfully claim workers’ compensation, you should invest time in making sure all paperwork is correct.
