A previous post on this blog discussed how not all of our clients, no matter how much they want it and how hard we try on their behalf, are going to qualify for benefits through the Social Security disability programs. As with other areas of the law, sometimes the law, including the federal regulations governing disability, and the facts just aren’t going to support one’s SSD claim.
The post also reviewed a couple of other option Boone County, Missouri, residents may have under such circumstances and indicated that our office could help pursue those options.
To give a better idea of what long-term disability benefits are, in many cases, a worker may be provided or have an option of buying a long-term disability insurance policy from his or her employer. These insurance policies are also available on the open market to individuals.
Much like the Social Security program, they are there to reimburse one’s lost income in the event the beneficiary of the policy gets hurt or falls ill and can no longer work. However, instead of payroll taxes, one pays a premium on the long-term policy in exchange for this benefit.
However, just like any other insurance policy, it is very important to read and understand the fine print, as the policy should spell out in detail when someone is considered “disabled” and to what extent the insurance company will pay out benefits in the event of a disability. The policy also will include restrictions, exclusions and important obligations a person must meet if he or she becomes disabled.
This private disability insurance can be a lifesaver for a Missourian who purchases it and then finds himself or herself suddenly unable to work and make and income to support himself or herself and his or her family. However, people should remember that one is working with an insurance company and dealing with a complicated legal document and claims process that may be difficult to understand and act upon.
