In what circumstances am I unable to claim workers' compensation?

All employees covered by workers' compensation insurance have certain rights to claim benefits. This means that workers who are legitimately injured by workplace incidents can claim back financial damages through medical treatment and lost wages. However, some injured workers may miss out on successfully filing for workers' compensation because of certain situations that they have found themselves in.

If you have been injured in the Missouri workplace, it is important that you understand how workers' compensation can be successfully claimed. By learning more about the reasons why many workers are unable to make a successful workers' compensation claim, you will have a better chance of being able to overcome such hurdles in your case.

Making your claim in good time is crucial

You should aim to report your injury and take action to make a legal claim for your injury as soon as possible after the incident. If you do not report your injury within 30 days of it occurring, you may be at risk of being ineligible for workers' compensation.

You will not be able to make a claim if you were engaging in horseplay

While fault attribution will not be a factor in workers' compensation eligibility, you may not be able to successfully claim workers' compensation if you were engaging in horseplay. You will, therefore, need to prove that you became injured while performing work-related activities.

If you have been injured at work, you should take swift action to understand the law. By doing so, you will be adequately equipped to claim the damages you deserve.
